1) Acceptance of Terms
By accessing or using our website, web app, or related services (collectively, the “Service”), you agree to these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.
2) Who May Use the Service
- You must be 18 years or older.
- You represent that you can lawfully enter into these Terms and will comply with all applicable laws.
3) Accounts & Security
- You’re responsible for your account credentials and all activity under your account.
- Notify us immediately of unauthorized use. We may suspend or terminate accounts for any reason, including safety concerns or policy violations.
4) Purpose of the Service (What We Do / Don’t Do)
- We are a nonprofit that facilitates connection, mentorship, and support between volunteers/adopters and people in prison (PIPs).
- We do not provide legal, medical, psychological, financial, or emergency services. Information on the Service is for general informational and educational purposes only and does not create an attorney-client, therapist-client, or similar professional relationship.
- Matches and communications are voluntary. We do not guarantee placements, outcomes, or replies.
5) Appropriate Use & Community Standards
You agree not to, and will not assist others to:
- Harass, threaten, exploit, or harm others; engage in hate speech; or send sexual content or explicit images.
- Request or send money, gifts, or financial details outside guidelines we provide.
- Share others’ private information without consent, including personal addresses, phone numbers, or identifying details.
- Impersonate any person or entity; misrepresent your identity or affiliations.
- Circumvent security features; upload malware; or interfere with Service operation.
- Use the Service for any unlawful purpose or in violation of prison or correctional policies.
We may moderate, restrict, or remove content and accounts at our discretion to protect participants and the organization.
6) User Content & License
- You retain ownership of content you submit (“User Content”).
- You grant Adopt an Inmate a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate, improve, and provide the Service.
- You represent you have the rights to submit User Content and that it does not infringe others’ rights or violate these Terms.
7) Privacy & Data
Our Privacy Policy explains how we collect and use personal information. By using the Service, you consent to those practices. Do not share sensitive personal data you are not comfortable disclosing.
8) No Monitoring Guarantee; Safety
We may review communications for compliance and safety, but we are not obligated to monitor all activity. Use common sense and follow any safety guidelines we provide. Report concerns to operations@adoptaninmate.org.
9) Third-Party Links & Services
The Service may contain links to third parties. We are not responsible for their content, policies, or practices.
10) Intellectual Property
The Service, including text, graphics, logos, and software, is owned by or licensed to Adopt an Inmate and protected by law. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works from the Service.
11) Feedback
If you provide ideas or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation.
12) Donations, Payments, & Fees (If Applicable)
Donations and any fees, if collected through the Service, are processed by third-party providers. Unless otherwise stated in writing, donations are non-refundable.
13) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
14) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ADOPT AN INMATE AND ITS DIRECTORS, OFFICERS, EMPLOYEES, VOLUNTEERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
15) Indemnification
You agree to indemnify, defend, and hold harmless Adopt an Inmate and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
16) Suspension & Termination
We may suspend or terminate access at any time with or without notice, including if we believe your use presents risk to others, to the organization, or to the integrity of the Service. Upon termination, your right to use the Service ends immediately.
17) Changes to the Service & Terms
We may modify the Service or these Terms at any time. Changes are effective when posted. Your continued use after changes means you accept the updated Terms.
18) Governing Law & Venue
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction and venue of state and federal courts located in Lane County, Oregon, for any dispute not subject to small-claims court.

19) Severability; Waiver
If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a term is not a waiver.
